Jessika Roswall

Was der ENVI-Beschluss bedeutet

Lass uns kurz aufdröseln, was das bedeutet hätte, damit du einschätzen kannst, was du dir gerade möglicherweise sparst.

Was die Pflicht bedeutet hätte

Was du jetzt konkret tun solltest

Was weiterhin gilt:

What the ENVI decision means

The Environment Committee of the European Parliament (ENVI) has voted by a clear majority to suspend certain requirements of the Packaging and Packaging Waste Regulation (PPWR) for micro and small enterprises. Specifically, this concerns the so called authorised representative obligation, meaning the requirement to appoint an authorised representative.
This comes from a LinkeIn post by Jessica Roswall (Commissioner for Environment, Water Resilience and Competitive Circular Economy).

What does this mean in practice? The decision is not a finalised law but an important interim step in a political process. EU Commissioner Jessika Roswall had already proposed this suspension in December as part of the so called Environmental Omnibus. The ENVI Committee has now taken up this proposal and approved it.

For this step to actually take effect, further steps are now needed:

  • The European Parliament must follow the committee's decision.
  • The Council must also adopt a position.
  • After that, the so called trilogue negotiations between Parliament, Council and Commission can begin.

The aim is for the suspension to come into force before the end of November, in good time before the Christmas season and Black Friday. For small online shops, the timing is crucial.

Which requirement exactly is to be suspended

At its core, this is about the so called Authorised Representation obligation from the PPWR, the EU packaging regulation. Let's briefly break down what this would have meant so you can gauge what you may be saving yourself right now.

What the obligation would have meant

Companies that place packaging on the market in EU member states without having a legal establishment there themselves would have had to appoint an authorised person or an authorised company in each affected market. This entity takes on compliance responsibility towards the authorities.

In concrete terms, for small online shops this would have meant:

  • Researching and selecting a suitable authorised representative for each target market
  • Drawing up contracts and having them legally reviewed
  • Coordinating reporting obligations and documentation
  • Budgeting for the ongoing costs of the appointment

This is not a one off effort but a permanent compliance structure that would hardly have been proportionate, especially for brands with small teams and modest export volumes. It is precisely this requirement that is now to be suspended for micro enterprises and small enterprises.

Who benefits and who doesn't

At first, the suspension sounds like good news for everyone. But it does not apply across the board to every online shop. What matters is which EU company size category you fall into.

Who the suspension is intended for

The ENVI decision is explicitly aimed at micro and small enterprises. These categories are set out in the EU recommendation on the definition of micro, small and medium sized enterprises. You can find the binding thresholds directly on the European Commission's website under the keyword "SME definition

What has to happen by November and why the timing matters

The ENVI Committee has done its part. But before the suspension actually applies, several more steps have to follow, and time is short. Here is the path the regulation must take before it becomes valid:

  • European Parliament vote: The plenary must follow the ENVI Committee's decision.
  • Council of the EU sets its position: In parallel, an official position from the Council is needed.
  • Start the trilogue: As soon as both sides are ready, negotiations between Parliament, Council and Commission begin. According to Commissioner Roswall, this is due to start in October.
  • Entry into force before the end of November: That is the declared goal, because Black Friday and the Christmas season are the highest revenue period of the year for small businesses.

That sounds like a tight schedule, and it is. If one of the steps stalls or the trilogue procedure is delayed, the suspension could come too late to have an effect on the year end business.

What this means for you: You cannot rely on the exemption yet. The course has been set, but the track is not yet clear.

What you should do now in concrete terms

The news is good, but it is not law yet. So that you are not waiting for relief that might arrive later than hoped, it pays to take action now. Here are the concrete next steps:

Step 1: Check your status

Find out whether your company counts as a micro or small enterprise. The exact thresholds for headcount and annual turnover are set out in the EU definition for SMEs. Your tax advisor or legal department can sort this out quickly.

Step 2: Keep an eye on the parliamentary progress

The plenary vote in the European Parliament and the position of the Council are still pending. Follow developments, ideally through an association or a legal advisor with a focus on EU regulation.

Step 3: Talk to your logistics partner

Regardless of the exemption, one thing holds true: the PPWR imposes requirements on packaging documentation and labelling that remain in force. Clarify with your fulfillment provider how your packaging processes are documented and where gaps still exist.

Step 4: Keep the remaining obligations in view

  • Labelling requirements for packaging apply independently of the authorised representative rule
  • Reusability and recyclability remain relevant criteria
  • Deadlines may vary depending on the state of national implementation

Those who sort out the basics now will be in a better position, no matter how the timing of the exemption ultimately turns out.

Conclusion: relief yes, pause no

The ENVI decision is a genuine relief, no question about it. If the authorised representative obligation for small businesses is suspended, a real chunk of effort disappears, especially during the peak season around Black Friday and Christmas.

But: the PPWR as a whole remains in force. Anyone who breathes a sigh of relief now and puts the topic of packaging compliance aside risks sleeping through the other requirements. What still applies:

  • Labelling requirements for packaging
  • Rules on recyclability and material composition
  • Documentation obligations towards national authorities

The suspension protects you from part of the bureaucracy, not from all of it. So do not use the breathing room you have gained to sit back, but to really tidy up your packaging processes.

A good fulfillment partner helps you keep track: which packaging you use, how it is documented and where action is still needed. This is not a luxury service but the operational foundation for PPWR compliant growth.
